Marriage and rap
Marriage and rap
In the Qur'an, one of the duties of marriage is that the girl gives her consent. The groom does not have the authority to say 'I accept' against the girl's will. Therefore, according to the Qur'an, it is necessary for a girl to be mature and wise for marriage, so that she understands her own good and bad while giving consent. The guardian is only obliged to communicate the girl's consent until the marriage ceremony. Nothing more than that.
If any marriage has been performed without the girl's consent, that is, only on the consent of the guardian, then it is not legally binding on the girl and if the bridegroom rapes such a bride even after knowing the truth, then it will be considered rape and Such a person can be severely punished under mischief per arz instead of the usual whipping punishment for adultery, which also has the death penalty as an option.
It is true that on the strength of fabricated hadiths, the form of religion has been completely distorted in this matter and now some sects perform the marriage of minor girls in their childhood with the will of the guardian. But all this is un-Islamic. There are anti-Islamic practices.
